PROPRIEDADE INTELECTUAL NO SETOR DA ERVA-MATE: MAPEAMENTO DO USO DE MARCAS E PATENTES POR EMPRESAS DO ALTO TAQUARI/RS

In the context of the yerba mate production chain, a sector of economic and cultural importance in southern Brazil, systematic protection practices through trademark and patent registrations remain limited. This study aims to analyze the presence of trademark and patent registrations with the National Institute of Industrial Property (INPI) by the leading companies that use yerba mate as a raw material, through applied research with a qualitative approach and an exploratory-descriptive approach. Data collection included a survey of 79 companies listed in the Forest Registry of Active Consumer Enterprises of the Rio Grande do Sul State Department of Agriculture (2025) as yerba mate processing companies in the seven municipalities that comprise the Alto Taquari region of Rio Grande do Sul, followed by individual searches of the INPI's trademark and patent databases by CNPJ number. It was found that 66 companies have already filed at least one trademark application, totaling 145 current registrations. In contrast, only four companies filed patent applications, with three granted. The data indicate that trademark protection is significantly more prevalent in the sector. The low incidence of patents highlights the need for greater technical support to identify protectable innovations, in addition to strengthening a corporate culture focused on research and development. The mapping conducted contributes to diagnosing the stage of intellectual property ownership in the yerba mate sector of Alto Taquari, serving as a basis for public and private initiatives aimed at promoting local production.
